The Department of Labor & Industries (L&I) is initiating rulemaking to amend Chapter 296-23 WAC in response to Substitute House Bill 1068 (SHB 1068), Chapter 166, Laws of 2023. This bill allows workers to audio and visually record their Independent Medical Examinations (IME).
Co-Recording of IMEs:
L&I is considering a new rule that would establish standards for co-recording IMEs. This ensures that workers can consistently co-record their examinations, while also retaining the right to make their own independent recordings. Learn more about this preproposal (CR-101).
Third-Party Recording of IMEs (Pilot Rulemaking):
L&I is also exploring the possibility of allowing third-party companies to record IMEs, provided the worker consents. This rulemaking will establish standards for third-party recording and storage of these recordings. L&I plans to use pilot rulemaking to develop the proposed rules. Workers will still have the right to record their IMEs independently. Learn more about this preproposal (CR-101).
These rulemaking efforts aim to provide clear guidelines and protections for workers participating in IMEs.
